Subject: – Request to transfer Sh. Sumedh Saini, IPS DGP Punjab, in view of charges framed against him by a Special CBI Court of Delhi for kidnapping, abduction and disappearance of three innocent citizens u/s 342,343,364,120-B of the IPC, RC No.2(S)/94. (copy of chargesheet attached)

Sir,

As stated above, Sh. Sumedh Singh Saini IPS, presently DGP Punjab, has been chargesheeted by a Special CBI Court of Delhi for kidnapping, abduction and disappearance of three innocent citizens u/s 342,343,364,120-B of the IPC, RC No. 2(S)/94. The said charges were framed against him vide order dated 06.11.2006, after the investigation was transferred to the CBI by the Hon’ble High Court of Punjab and Haryana in CRM No. 4035 of 1994.

It is pertinent to mention here, that Sh. Sumedh Saini IPS has very close proximity with Sh. P.S.Badal Chief Minister and his son Sh. Sukhbir Badal Dy. Chief Minister cum Home Minister of Punjab. The ruling dispensation has handed out the prestigious position of Director General Police to Sh. Sumedh Saini IPS, after superseding five IPS officers senior to him, immediately after assuming power in 2012. Earlier, Sh. Sumedh Saini IPS then IGP, was appointed Director Vigilance in 2007, after scrapping the Punjab Vigilance Commission set up the previous Congress govt. of 2002-07, in conformity with the directions given by the Hon’ble Supreme Court in the Vineet Narayan’s case (1998) I SCC 226. In order to give a free hand to Sh. Sumedh Saini IPS, as Director Vigilance to settle scores with his political opponents, Sh. Badal Chief Minister purposely kept the post of Chief Director Vigilance vacant for 18 months, before elevating Sh. Saini as Chief Director Vigilance.

            It is a matter of record that as Chief Director Vigilance, Sh. Sumedh Saini was instrumental in victimizing Capt. Amarinder Singh Ex-Chief Minister and many senior Congress leaders, by registering false and frivolous criminal cases against them, merely to please his political masters.

            Sh. Sumedh Saini, IPS as Chief Director Vigilance, played a key role to demolish the Corruption and Disproportionate Assets case against the family of Sh. P.S.Badal Chief Minister, by pressurizing key official witnesses including the Investigating Officer (I.O) and his crony Sh. S.S.Virk IPS, to resile in the matter.

            Only recently a drug lord Jagdish Bhola arrested in a sensational Rs. 6000 crore drug racket had named Sh. Bikram singh Majithia Revenue Minister and brother in law of Dy.CM Sh. Sukhbir Badal, as one of the key players involved in drug trafficking in Punjab. Acting under political pressure from Sh. Sukhbir Badal Dy.CM cum Home Minister, Sh. Sumedh Saini DGP gave a clean chit to the accused Minister Sh. Bikram Majithia within 24 hours, without any investigation.

It is common knowledge in the state of Punjab, that the Punjab Police under Sh. Sumedh Saini, IPS DGP, is virtually acting as a private army of the Badal family and has been witch hunting opposition leaders on their directions. The Punjab Police has become a highly politicized force virtually acting as an extension of the Shiromani Akali Dal in Punjab, as all key field police postings are done on the asking of ruling party Ministers and MLA’s.

It is noteworthy, that my request is in accordance with the directions and the guidelines issued by the Election Commission of India, vide Letter No. 437/1/2014-CC&BE dated 19th January 2014, Para 5 that reads “ the commission further desires that no office/official against whom a criminal case is pending in any court of law be associated with the election work or election duty.”

            Therefore, it is highly impossible to hold free and fair elections under the command and leadership of a tainted and partisan officer like Sh. Sumedh Saini, IPS DGP Punjab. Hence, it is requested that the Election Commission of India intervene in the matter, to transfer Sh. Sumedh Saini IPS from his present position as DGP Punjab, so that free and fair elections of Lok Sabha can be held in the state.
